Danish Tax Authorities reduce statutory deadline for withholding tax refunds

The Danish Minister of Taxation proposal to reduce the deadline for reclaims of Danish dividend withholding tax from 5 to 3 years, will be effective the 13th of September 2016

The deadline will be changed from 5 to 3 years, as follows. This follows recent confirmation from the Danish Tax Authorities (SKAT).

From 13 September 2016 3 years

 

Note: Certain countries may have a longer statutory deadline than three years, as stipulated in the relevant Double Taxation Treaty. In such cases, this deadline will still continue apply.

 

 

 

Impact on customers

In accordance with the amended deadline, reclaim requests to be covered under the current 5 year deadline must be provided to Globe Refund no later than 13 July 2016, to ensure that Globe Refund has sufficient time to process and forward the request to SKAT before 13 September 2016. Refund applications received after this deadline will be processed by Globe Refund on a “best efforts” basis and Globe Refund will in these cases accept no responsibility for forms that have not reached the Danish Authorities by the date considered as being the statute of limitations deadline.
